Terms of Service

The short version

Toss is provided as-is by AZAI Corp. Use it to move your own files between your own devices. We don't host anything. You're responsible for what you transfer. If something goes wrong, our liability is limited to what you paid us — which for most users is zero.

1. Who's offering this

"We", "us", "Toss", and "AZAI" refer to AZAI Corp., incorporated in British Columbia, Canada. "You" means the person or organization using Toss. By installing or using Toss you agree to these terms. If you don't agree, don't install it.

2. What Toss is

Toss is software you install on your own devices. It transfers files directly between those devices over local network connections. We do not host your files, route your traffic through our servers, or store copies anywhere.

3. License

We grant you a personal, non-exclusive, non-transferable license to install and run Toss on devices you own or control. You may not reverse engineer, redistribute, sublicense, or resell Toss.

4. Acceptable use

You agree not to use Toss to:

• send anything you don't have the legal right to send;
• distribute malware, illegal content, or material that violates another person's rights;
• circumvent any security feature of the app;
• do anything that violates the laws of your jurisdiction.

Because Toss runs entirely on your devices, we cannot enforce acceptable use at our end. You're responsible for what you transfer.

5. Payments

Toss is free up to 1 GB per transfer. A one-time $29 CAD purchase unlocks larger transfers. Payment is processed by Google Play Billing; their terms govern the transaction. Refunds are at Google's discretion under their refund policy.

6. Your data, your files

Your files belong to you. We never access them. Toss does not collect personal information — see our Privacy Policy for specifics.

7. As-is, no warranty

Toss is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Toss will be uninterrupted, error-free, or that any defect will be corrected.

8. Limitation of liability

To the maximum extent permitted by law, AZAI Corp. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of Toss. Our total aggregate liability for any claim shall not exceed the amount you paid us for Toss in the twelve months preceding the claim — which for most users is CAD $0.

9. Indemnity

You agree to indemnify and hold AZAI Corp. harmless from any claim, damages, or expenses arising from your use of Toss in violation of these terms or applicable law.

10. Changes to the service

We may update, change, or discontinue Toss at any time. Material changes will be noted in release notes or on this page. Continued use after a change means you accept the change.

11. Termination

You can stop using Toss any time by uninstalling it. We can terminate your license if you violate these terms.

12. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute that cannot be resolved between us shall be brought before the courts of British Columbia, and you consent to that jurisdiction.
